Please read the following terms and conditions carefully, as they form the basis of your contract with Paradise Yakari concerning any booking made through our website, email, or in person. By making a full or partial payment for your booking, you and all associated travelers agree to these terms and conditions.
Disclaimer
Paradise Yakari shall not be held liable, under any circumstances, for illnesses, personal injuries, death, damages, losses, accidents, delays, emotional/mental distress, or harm to individuals or property caused by any reason, nor for any associated financial expenses that may arise during our tours or through communication with our company by any means.
By participating in any tour organized by Paradise Yakari:
- You agree to assume all associated risks and responsibilities.
- You are strongly advised to obtain adequate travel insurance for each participant.
- You, your successors, executors, and administrators are subject to these Terms and Conditions.
- You agree not to initiate legal proceedings in any country regarding the above-mentioned risks and responsibilities.
- You agree to indemnify Paradise Yakari against any claims related to the described risks.
- You confirm that you are physically fit to participate in the tours.
- You confirm that you do not suffer from any medical condition that could impair your ability to participate.
- In the event of injury, accident, or illness, you agree to receive medical treatment and waive any claims, costs, or expenses related to the treatment.
- You commit to following the instructions of our guides/drivers/hosts and ensuring that any minors under your care do the same.
Media Policy
By participating in any tour organized by Paradise Yakari:
- You agree that any video, audio, images, or other recordings captured during the tour will not be used in public or commercial productions without prior consent from Paradise Yakari.
- You authorize Paradise Yakari to use any audiovisual material taken during the tour for promotional purposes, without requiring additional prior approval.
Payment Policy
- All reservations require a non-refundable deposit of 50% per person, unless otherwise agreed in writing.
- The remaining balance must be paid at least 30 days prior to the tour start date. If full payment is not received within this timeframe, Paradise Yakari reserves the right to cancel the booking without refund.
- Payments must be made in the currency and format specified on the invoice. Any conversion or additional fees applied by banks or credit card issuers will be the client’s responsibility.
Cancellation and Refund Policy
- All payments and deposits made are non-refundable and non-transferable.
- Refunds are not offered for reasons such as altitude sickness, food poisoning, family emergencies, illnesses, acts of God, or any other reasons provided by the client.
- Paradise Yakari reserves the right to modify or cancel a tour due to adverse weather conditions or unforeseen circumstances.
- If Paradise Yakari cancels a tour before it begins, the client will receive a travel credit equivalent to the amount paid, valid for one year from the original booking date.
- If a tour is canceled after it has started, no refunds or credits will be issued.
Other Provisions
- Physical and Medical Conditions: It is the client’s responsibility to ensure they are in suitable physical condition to participate in the activities booked.
- Legal Compliance: Paradise Yakari strictly complies with Law No. 29408 and strongly condemns any form of child exploitation, human trafficking, or related illegal activities.
- Jurisdiction: Any disputes related to our services will be governed by the laws of Peru and resolved under the jurisdiction of Peruvian courts.
